Kazaa sued in class action

p2pnet.net News:- It was on the way.

Yesterday, “It can only be a matter of time before Sharman Networks’ Kazaa p2p application shows up as the star in a class action,” p2pnet posted in a story on a new RIAA customer persecution case involving Thomas J. Korb and the members of Big Four Organized Music cartel, Warner Music, EMI, Vivendi Universal and Sony BMG.

Why? Because Kazaa, “seems to be almost always front and centre in every Big Four Organized Music cartel sue ‘em all case,” we said.

And now it’s happened.

Catherine Lewan was a Kazaa user who was sued by the Big Four’s RIAA (Recording Industry Association of America) for using the p2p application, owned by Australia’s Sharman Networks.

She was one of the people who paid extortion money to the RIAA and in a court document, says Sharman, “configured KaZaA such that its intended use would be illegal”.

It also deceptively marketed its product as allowing “free downloads,” says Recording Industry vs The People.

Kazaa designed its software, “in such a manner as to create a shared files folder and make that folder available to anyone using Kazaa, while at the same time failing to make the user aware that it had done so,” says the post, going on:

“It surreptitiously installed ’spyware’ on users’ computers which made the shared files folder accessible to the Kazaa network even after the user had removed the Kazaa software from his or her computer.”

Represented by Charles Mudd, Lewan is the first to name Kazaa specifically, but she won’t be the last.

The “amount in controversy exceeds $75,000,” says Lewan’s claim.

When Sharman paid $115 million in Kazaa settlement fees, we wondered what would happen to the personal information it has on millions of people around the world.

We still wonder.

Definitely stay tuned.

One Response to “Kazaa sued in class action”

    http://www.theinquirer.net/default.aspx?article=36249

Nikki Hemming, of Sharman Networks, was in the dock in the Federal Court of Australia in Sydney over a row about a list of her assets ahead of a possible court order for damages against Kazaa’s owners.

  2. Reader's Write Says:

THE criminals are in fact the greedy people who faked Kazaa with Spyware. Kazaa was buyed and faked for the only purpose to rip off peple. Now the bastards have to pay back!

  3. Reader's Write Says:

This is neat John, another chance to libel someone who didn’t take advertising with you. Everyone has noticed that you don’t want the truth about your own libel case and the various comments denouncing your behaviour to have the same kind of freedom that you give to any libel against your last victim as a publisher

  4. Reader's Write Says:

Most suspicious that our troll about the “wrongs” Jon does chooses this topic to reply in. I would say right off the bat it is someone with an axe to grind and hopes to provoke some sort of response proving that Jon does indeed keep logs. Why else would one want to provoke and goad?

Keep up the good work Jon. You can see by such responses you are hitting “sensitive nerves”. In this application, always a good sign.

  5. Reader's Write Says:

what a dum ass with a comment like that….

” Most suspicious that our troll about the “wrongs” Jon does chooses this topic to reply in. I would say right off the bat it is someone with an axe to grind and hopes to provoke some sort of response proving that Jon does indeed keep logs. ”

    Precisely.
He is trying to get ANY kind of response he can use to
pass along to his ‘boss’ .. ain’t that right Gachnar ?

BTW, there was no libel by Jon.

For all of the FACTS ..

    http://s22.quicksharing.com/v/3421267/P2Pnetsuit.zip.html

    Just the facts, no spin.
All of this info is public, so no libel here either :)

  7. Reader's Write Says:

Apparently anyone who expresses freedom of speech that contradicts you John is a troll…again how do we get onto the list of people you allow to express freedom of opinion, or even better let us all know how you stay off the list of people who can be victimised by your brand of freedom of speech so we don’t end up like Hemming.

BTW, I thought your defence was there was alibel but it was beyond your control or has your freedom of speech extended to freedom to speak of alternative versions of the truth?

  8. Reader's Write Says:

Glad you still ’sign’ your posts.

“BTW, I thought your defence was there was alibel but it was beyond your control or has your freedom of speech extended to freedom to speak of alternative versions of the truth? ”

    No alternate version at all.
the COMPLETE facts of the case are here …

    http://s22.quicksharing.com/v/3421267/P2Pnetsuit.zip.html

I guarantee that anyone reading this will have no doubt about
the absolute ridiculousness of Hemmings claim.

    No libel.
    none,

    but you know that already.

  9. Reader's Write Says:

” Apparently anyone who expresses freedom of speech that contradicts you John is a troll ”

So why can’t Jon speak freely about the stuff you are
    referring to troll ?
It’s because a large well monied entity has used it’s financial
weight to Censor Jon. He can’t speak out on his own behalf,
due to financial censorship. Someone who Jon doesn’t know
or ever met expressed freedom of speech that contradicted
Nikki Hemming, so therefore Jon can be censored, not by
weight of law, but by large buckets of cash ?

Free Speech is only for your wealthy owners, troll ?

  10. Reader's Write Says:

like we’re going to click YOUR link. HAHAH

“It surreptitiously installed ’spyware’ on users’ computers which made the shared files folder accessible to the Kazaa network even after the user had removed the Kazaa software from his or her computer** this whole sentence is bs except for installing spyware which it does. but the spyware doesnt make the folders available on the kazaa network at all it just pops up ads.

  11. Reader's Write Says:

When one has no other logical or reasonable stance …. :)

That’s all you have left Eh Gach ?

  12. Reader's Write Says:

Just the fact that the troll wants to scare people away was enough to make me check it out. It’s a text file and a very interesting read. No wonder the troll has resorted to profanity.
