Joe Barton: firmly behind DMCRA

p2pnet.net News:- The biggest ray of hope in the hearing on the Boucher / Doolittle Digital Media Consumers’ Rights Act (DMCRA, HR 107) came during a lunch break, says EFF staff attorney Fred von Lohmann.

The House Energy and Commerce subcommittee on Trade, Commerce and Consumer Protection hearing on HR 107 is promising, says von Lohmann, but, “The biggest ray of hope came during a lunch session that took place during a recess in the testimony of the 13 witnesses,” he states.

“Rep Barton announced that he intends to see the bill marked up, passed by the subcommittee, passed by the full committee, passed by the full House of Representatives, and ultimately signed into law by the President.”

Joe Barton took command of the House Energy and Commerce Committee in February.

“Fortunately, despite the efforts of Hollywood lobbyists, the message that the DMCA is broken and needs fixing got through,” adds von Lohmann.

This is the first time a DMCA reform bill has made it to the hearing stage.

“Its success is a testament to the efforts of the roughly 30,000 citizens who have used EFF?s Action Center to write to Congress to support the DMCRA, as well as the efforts of 321 Studios, which has hired lobbyists to explain the importance of fair use in the digital age,” says the EFF.

    This law needs to be fixed If I purchase a dvd I should be able to copy it for my OWN family use and the law should read anyone caught illeally selling copied dvd’s should be procsecuted.

    I paid a large amount of money for one of 321 studios products around the time of the removal of the items from the shelves. When i went to activate the product, several of its intended uses were not enabled. My simple question is for the hollywood lobbyists who seem to be showing their greed… Will you refund my hard earned money that I paid for this product now that it is useless?

    I think the interest on Hollywood moviemakers it’s all about profit. They really careless about consumers. The bottom line here is that consumers shall have the right to back up their expensive dvd’s, cd’s, videos or e-books without any prohibition. I think is a constitutional right.

    The software makers of the so-called illegal rippers are not doing anything wrong as long as they clearly state that to make backup copies not intended for the owners personal use is illegal and against the copyright of artists and film companies.

    The right thing to do should be to create ways to punish people that violates the anti-piracy law, and not limitating the ability of consumers to protect their investments on dvd’s.

    Think of this, by banning drugs it does not mean their won’t be drug dealers and this kind of business it’s really illagal, so the same will happen with the dvd ripper software companies, they will continue to sell their products but in the black market.

    So, let use common sens and be smart, how many consumers will spend two hours ripping a dvd to sell it for 5 bucks, I don’t think there will be many and on the other hand if you allow people to back up their owned dvd’s consumers will be motivated to buy more. Just imaging that you spend up $30 in a single dvd and next day its all scratched and you can’t use it, well, you have lost your investment. Common, most consumers pay to see the new release at the theaters and then bought it on dvd, already the Film maker profitted from these consumers twice and still are opposing to the existing of software to rip dvd’s for personal use.

    When you buy a dvd you are also aquiring a personal license to enjoy the dvd, this means you can enjoy the product for your own use anyway you want to; and as long as the consumer does not reproduce it to sell or to rent or make copies to give to a friend or relative, there is nothing wrong on making a personal back up copy, on the contrary you are protecting your precious investment to back it up if your already existing copy get damaged or destroyed.

    Most of the people who buys a copy from vendors dedicated to the piracy don’t spend over an hour making a copy, they have state of the art equipment that makes hundreds or thousands.

    Please, get the point. No consumer will spend their valuable time to sell a back up copy for $15.00 cuase their will be no one to but it, cause that possible buyer will rather go to blockbuster and buy a pre-vied for much less. And no consumer will spend more than an hour to sell a product that may only be sold for less than 5 bucks, it’s not worth its time. Be realistic, how many copies should a consumer make in order to become a real good business and keep in mind that not to many knowing that if they are cought they will go to jail for a thing that is not to profitable.

    It may be profitable for those piracy companies that sell not 10 or 20 a week but 1,000’s. All those sellers that you see at flea markets selling this kind of stuff are sellers that they only sell don’t burn the product, there is a business behind them whom is profitting from thousands of sellers around the globe.

    These are my thoughts and hope congressmen can listen to them and not to the villians of Hollywood who only seek for money money money.

These are underground websites use them only to get your rights back to copy your leagly bought dvd’s. As you can see Im a Hacker and there is no way you can get in trouble for doing this i should know only because they have no way to track you.

    I have dozens of scratch dvd movies and pc games,i also bought dvd x copy platinum and game x copy,so i can protect my self from losing the money i put in to it.There is too much GREED on those hollywood companies.I have to fix my computer and now i can’t activate my software again. Can anyone help me out.
    Will the game companies or dvd companies refund or replace my dvd’s and games????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????????//
