Eminem vs Apple

Is Eminem “Enraged at the unauthorized use of his music,” as E-Online would have it here?

“My guess is it’s another publicity stunt. If the man had breasts I’m sure he’d get whatsherface Jackson to rip off his costume on live TV!”

Either way, a US federal judge has ruled that m-and-m ( Marshall Mathers III) has a case against Apple Computer for using his lyrics without permission.

Mathers claims a tv commercial for iTunes aired last year with a young boy singing ‘Lose Yourself,’ the theme song for Eminem’s movie 8 Mile.

It also showed up on Apple’s iTunes site.

“Apple CEO Steve Jobs personally approached Eminem and 8 Mile Style manager Joel Martin, asking them to ‘rethink their position’,” says E-Online, adding that no trial date has been set.

    Apple executives asked to use the song and were turned down. The Eminem lawyers even have an e-mail from Apple execs where they confirm the refusal and express disappointment. Then the company just went ahead and used it anyway instead of having the kid in the ad sing a song by any of the truckloads of artists who’d be thrilled to lend their music if it would earn them a couple of extra bucks to throw on the pile. I’d be mad about that myself, and I’m not even known for having a temper. It also harms Eminem’s career and public image by making it look like he “sold out” - most people who see the ads would assume he sold them the right to use the song. Regardless of what any of us might think about his personal integrity, he has a history of disregarding the sacks of cash he could make through commercial endorsement, presumably to preserve public respect. I can’t believe the people at Apple thought they could get away with screwing a major artist like that, especially one who seems so touchy and vengeful.

    You know what? This might turn out to be a good thing after all. For once there is an individual with the money and time to strike back at the Big Music and the companies that represent it. A lot of our troubles would not exist if major multinational conglomerates did not behave as if they were untouchable and all powerful. Rules must apply to them as well and I think that a case like this might be the first step. If the case is as blatant as it seems there should be little trouble having the book thrown at Apple, or at least forcing a hefty out of court settlement. Though somehow I don’t think Eminem would settle out of court. Regardless of if he’ll use this as publicity, I honestly believe that he is aware of the power position he wields at the moment. For all the crap he takes, I sense that he’s got enough business sense and spite to really screw Apple, and in the public eye to boot.

    Serves them right anyhow. The actually thought they could get away with a national ad campaign using a song against the wishes of the artist? Get real.

    That’s almost as absurd as the cost discrepency between Napster UK and Napster US where cents and pence are assumed to be equal! 1.09 GBP for a song? That’s almost 2 dollars! Funny, all of a sudden I feel a lot less bad about buying music from the Russians. AllofMp3.com is the best service out there. 1 penny per megabyte!!! $10 for 1 gig!!! Spread the word and get over there, if the entire market shifts over to the Russians and their price model the other markets will have to adjust to the expectations of the consumers, not vice-versa.

    look, do you think Apple gives a rats ass about some “wood-hoods” “OK” for the use of his music?….hell no. i remember when itunes first came out..people could view other peoples play lists AND download what ever they wanted from that person. Apple doesn’t care about big music and the way that gestapo tries to invoke it’s “reasonings” on the rest of society. “Intellectual property” is a bunch of bull…it’s just yet another phrase followed up by pages of legal jargen only to keep the pockets of the wealthy overflowing with cash.

    “no, you can’t use my song..waah,waah..i’m a little baby. i have to listen to the record company…sobb,sobb…i can’t make my own decisions”………..

    ………i hope Mr Jobs tells that no talent little prick to piss off.

    I Think apple should have asked because really eminem should have gaven them permission for his own song he had written to be on apples IPod. And I Think that eminem should be getting paid what he deserves. But also even though apple put eminem’s song on the IPod without his permission I think it is somewhat okay because I get to listen to his great song. GO EMINEM.
