Police raid ThePirateBay

p2p news / p2pnet: Sweden’s ThePirateBay.org is down and although TPB and Mininova, “aren’t really comparable, this is a worrying situation,” a mininova spokesman told p2pnet, “especially since our DNS and IRC services are hosted at PRQ, TPB’s data center.”

Hollywood has been targeting torrent sites for some time with TPB remaining online, the best efforts of the Big Six studios’ MPAA (Motion Picture Association of America) notwithstanding.

Torrentspy, one of the sites hit, is currently claiming the MPAA paid a hacker $15,000 to steal email and trade secrets.

The cartels routinely use local enforcement agencies as industry cops and, “Approximately 50 police participated in the raid, which placed into custody two PirateBay.org personnel,” says Slyck.

Meanwhile, “The police right now is taking all of our servers, to check if there is a crime there or not (they are actually not sure),” the story has site’s brokep saying, and, “The uncertainty on the part of the police may stem from the fact ThePirateBay.org’s servers only host .torrent files, not actual copyrighted material,” it states, going on:

“As a tracker, ThePirateBay.org’s function is to index .torrent files and to direct BitTorrent traffic and maintain the swarm (uploads and downloads.) The downloaded .torrent file contains all the necessary information to locate and download the queried file. The legality of indirectly linking to copyrighted material has yet to be tested by Swedish courts.

“Whether this will keep ThePirateBay.org offline indefinitely is another matter.”

However, the TPB spokesperson doesn’t seem to be in any doubt.

Says brokep, “We are not sure when it will return, but we are moving it to another country if necessary.”

“According to The Pirate Party, a Swedish copyright reform organization, the raid also seized Piratbyrån’s (the Pirate Bureau) servers,” adds Slyck. “Piratbyrån is a educational and quasi-political organization which performs a public service role similar to The Pirate Party.”

    Google is just indexing the torrent files where the pirate bay is hosting them. Theres a big difference there. Both are legal in Sweden I thought though.

    I suspect the Pirate Bay will be up an running again very soon - I also suspect ALL the torrents will be moved to other trackers. I also suspect that MOST of the copyright material “stolen” via BitTorrent trackers would not have been bought by the so called “offenders” anyway, I suggest very few so they do not represent a loss of sales to the over greedy industries anyway. Secondly: what is the legal standing of people downloading music from torrent sites for which they already hold either a an old fashioned vynil or broken CD copy? (I believe this entitles the owner to make as many copies for his/her own use in perpeuity) and do the punishments for this include life in prison or dinner with Robert Mugabe? Also what evidence do the authorities have that people haven’t just downloaded a file to try - then bought a pukka copy afterwards? Next: what is the position of people who pay to download music - then accidently wipe it or lose their MP3 players, crash their hard disc, etc. Does the music industry expect them to buy the material again and if so is this not blatant racatering on their behalf? Finally - what is the legal position on people recording off a DAB or DVB transmission for later viewing/listening via their PC’s, since recording a television programme onto VHS tape is not an infringement of copyright or nearly everybody in the entire world would have to be taken to court, including the gloating peeps from MPAA - how ironinc would that be!!!

    I wouldn’t worry, I think it is just their server is overloaded or some other cause. This has happened numerous times in the past month as seeledrs popularity has ballooned. Maybe they need more bandwidth/better servers and/or cannot afford it.
    It usually comes back online though.
